The Transfer of Development Rights (TDR) Program for Historic Properties
described in Chapter 23 of the Miami City Code (Historic Preservation)
uses the Miami 21 Public Benefits Program for its implementation.
TDRs allow Eligible Historic Resources located in transects zoned T4O and
higher to preserve their historic properties while still obtaining a fair market
value for their unused base development rights (usually in the form of
additional stories or square footage) by selling these rights to another
property in a T6 zone.
How TDRs for historic resources work under Miami 21
The Zoning Administrator calculates the difference between existing sq. ft. of the historic building and the potential sq. ft. allowed in that transect zone. The difference between the two is known as Unused Base Development Rights. These may be transferred (sold) through the TDR
program to developers in T6 zones wishing to increase their building capacity.
The price of Unused base Development Rights will vary, as the sale is
negotiated in the private market.
